High Court cites violation of constitutional rights, and orders swift action to secure students' education.
The Allahabad High Court has stepped in to protect the rights of three minor students who were expelled from a private school in Uttar Pradesh's Amroha for allegedly bringing non-vegetarian food in their tiffin boxes. The incident, which sparked massive outrage, has brought to light the discriminatory practices faced by students based on their religious identity.
According to PTI, In response to a writ petition filed by Sabra, the mother of the children, the High Court directed the District Magistrate of Amroha to ensure their admission to another CBSE-affiliated school within two weeks.
A bench comprising Justices Siddharth and S.C. Sharma further ordered the District Magistrate to file an affidavit of compliance by January 6, 2025, warning of personal appearance in case of non-compliance.
The petition alleged that the student바카라”a Class 3 student and two siblings바카라”were expelled in September 2024 by Principal Avnish Kumar Sharma after he objected to them bringing non-vegetarian food to school. As reported by Live Law the plea also argued that the actions of the school administration violated the student's rights under Article 17 of the Indian Constitution, which prohibits untouchability, as well as Sections 5 and 6 of the Protection of Civil Rights Act, 1955.
Adding to the controversy, a video of a confrontation between Principal Sharma and the children바카라™s mother surfaced on social media. In the video, Sharma can be heard making derogatory remarks about the boy바카라™s religious identity, stating he 바카라śwon바카라™t teach children who will demolish temples after growing up.바카라ť These comments have led to widespread condemnation and calls for accountability.
The counsel for the petitioners emphasized that the expulsion had adversely impacted the children바카라™s fundamental right to education, guaranteed under the Right of Children to Free and Compulsory Education Act, 2009.
The matter is scheduled for a fresh hearing on January 6, 2025, where the compliance report will be reviewed.
