The Supreme Court on Monday refused to put a stay on the demolition notices issued for Batla House area in Delhi바카라s Jamia Nagar, and asked the petitioners to approach appropriate authorities for further redressal.
A vacation bench of Justice Sanjay Karol and Justice Satish Chandra Sharma refused any interim stay on the 15-day eviction and demolition notices issued to the residents of Batla House.
The matter will now be heard in July.
The petitioners 바카라 Sultana Shaheen and 39 other property owners of Batla House 바카라 challenged the demolition notices which arrived on May 27. The petition stated that the residents were not part of the May 7 Supreme Court ruling or case following which the demolition notices were sent.
바카라They are genuine residents and property owners of Khasra Nos. 271 and 279, Batla House, who have now received 15-day eviction/demolition notices on May 27, 2025, according to the Court바카라s order on May 7, 2025, without being made parties to the writ petition or being granted an opportunity of being heard,바카라 the petition mentioned.
The petition also states that the residents hold valid documents proving continuous possession since before 2014, and eligibility under the Recognition of Property Rights Act, 2019. The petitioners claim that the land is not encroached upon public land, as suggested by the eviction notices.
바카라The authorities have failed to distinguish between illegal encroachments and bona fide property holders, GPA holders or applicants under the regularisation scheme, thus resulting in gross arbitrariness.바카라
It is claimed that without the adequate and meaningful opportunity of being heard, the principles of natural justice would be compromised and it would be a direct violation of fundamental rights.
As reported earlier by Outlook, the eviction orders follow the Supreme Court바카라s May 7 ruling, which declared that their houses fall outside the scope of the PM-UDAY (Prime Minister 바카라 Unauthorised Colonies in Delhi Awas Adhikar Yojana) scheme and are therefore considered illegal encroachments.
PM-UDAY, decided by the Union Cabinet, confers the ownership or transfer and mortgage rights to the residents of 1731 Unauthorized Colonies in Delhi.
Under the scheme, the residents are allowed to sell, purchase the properties without any hindrance. They can also avail loans from banks and financial institutions against their properties.
바카라The occupants of this building/structure are hereby directed to vacate the premises within 15 days of issuance of this notice. The demolition program shall be carried out from 11-06-2025 (Wednesday) without any further notice,바카라 the notice further mentioned.
The residents - some of whom have spent their entire lives in the locality - are now clueless about what their next course of action should be. The move threatens both shelter and livelihoods.
